DISTANCE SALES CONTRACT

The subject of this Distance Selling Agreement (“ Agreement ”) is the determination of the rights and obligations of the parties in relation to the sale and delivery of the product (“ Product ”), the characteristics and sales price of which are specified below, sold by the Seller to the Customer, in accordance with the provisions of the Consumer Protection Law No. 6502, which entered into force on 28.05.2014, and the Distance Contracts Regulation published in the Official Gazette No. 27866, dated 27.11.2014.

Hereinafter, the Seller and the Customer will be referred to individually as a " Party " and together as the " Parties ".
3. DEFINITIONS
In the interpretation of the Preliminary Information Form and the Distance Sales Agreement, the following expressions have the meanings attributed herein.
cemreshop: It is a website with the extension cemre.shop.
Customer/Customers: Real person/persons who acquire the Product sold through cemreshop for commercial or non-professional purposes.
4. PAYMENT
4.1. Payment Options
a. Credit Card: You can make purchases using your credit card for orders placed through cemreshop, paying in cash or in installments through the virtual POS terminals of payment service providers authorized by the Central Bank of the Republic of Turkey (CBRT) or the Banking Regulation and Supervision Agency (BRSA). You can use credit cards from all banks for cash purchases.
b. Bank Card: You can pay for your orders placed through cemreshop by using your bank card and using the virtual POS of payment service providers authorized by the Central Bank of the Republic of Turkey or the Banking Regulation and Supervision Agency.
Debit cards from all banks are valid.
c. Money Order / EFT: You can pay for your orders placed through cemreshop via money order or EFT.
To do this, while creating your order, select the bank you want in the payment step by money transfer or EFT and complete your order.
After completing your order, transfer money from the internet branch, mobile branch, bank branch or ATM of the bank you are a customer of.
- Things you should pay attention to when making a money transfer:
- When you select the Wire Transfer / EFT option during the payment phase, you must transfer the money to the bank account number or IBAN that appears.
- You must write your "Name-Surname" and "Order Number" in the Money Order/EFT/FAST description section.
- You must make a transfer for your full order amount including shipping costs.
- Once you enter all the information completely and accurately and make a money transfer or EFT transaction, your order will be confirmed within 1 business day.
Your bank may charge a processing fee for this transaction.
4.2. The type, quantity, brand/model, color, number of products, final sales price including all taxes and shipping costs , and payment method are as stated below.

4.3. Packaging, shipping, and delivery costs are covered by the Customer. The shipping fee is 160 TL and is added to the total order amount. It is not included in the product price.
4.4. If the Customer selects the corporate invoice option when placing an order, the Seller will issue a corporate invoice using the tax identification number and tax office information provided by the Customer through cemreshop. It is the Customer's sole responsibility to ensure that the information required for the invoice is accurate, current, and complete, and the Customer is solely responsible for any damages that may arise from this.
5. TERMS OF USE AND GENERAL PROVISIONS
5.1. The Seller accepts that the information regarding itself in this Agreement is accurate and up-to-date and that it has informed the Customer about all its rights through the Preliminary Information Form and the Agreement.
5.2. The Seller will answer questions regarding the order using the contact information provided in the Preliminary Information Form and the Agreement. In this context, the Seller may request information that will confirm the Customer's identity in accordance with its procedures regarding the processing of personal data.
5.3. All information, including fees, contained in cemreshop are valid until changed by the Seller via cemreshop.
5.4. If a discount code has been assigned to the Customer that allows him to pay for one or more products, the Customer cannot claim any refund or compensation if the order is cancelled due to the discount code not being used within the specified period or due to the Customer using it in a manner that violates the terms of use or abusively.
6. DELIVERY
6.1. Delivery will be made by hand to the Customer's address specified above, via the contracted courier company. Even if the Customer is not present at the time of delivery, the Seller will be deemed to have fully and completely fulfilled its obligations. Therefore, the Seller is not responsible for any damages or expenses arising from the Customer's late or no delivery of the product. The Seller is responsible for ensuring that the product is delivered intact, complete, compliant with the specifications specified in the order, and accompanied by any warranty documents and user manuals.
6.2. Your international orders will be delivered to our contracted cargo company within 3 (five) - 5 (ten) business days after confirmation.
6.3. The Seller is responsible for delivering the product subject to the Contract in a sound and complete manner and in accordance with the specifications specified in the order.
7. CUSTOMER'S DECLARATIONS AND COMMITMENTS
7.1. The Customer accepts and declares that he/she has read and is informed in the Preliminary Information Form regarding the basic characteristics, sales price, payment method, delivery and right of withdrawal of the product subject to the Contract at cemreshop, that these are consistent with the information above, and that he/she has given the necessary order confirmation electronically in order to purchase the product subject to the Contract and have it delivered to the address stated above.
7.2. The Customer undertakes that the tax number, tax office information and all other information provided to cemreshop when becoming a Customer is true and correct, and that it will immediately compensate the Seller for any damages it may incur due to the inaccuracy of this information upon the first notification from the Seller.
7.3. The Seller reserves the right to discontinue, update, or change the terms and conditions of promotions/campaigns announced on CemreShop at any time. The Customer must review the terms and conditions of any promotions/campaigns and discount codes before placing any orders through CemreShop.
7.4. Unless otherwise clearly stated on cemreshop, the customer cannot benefit from more than one promotion, campaign or discount code in the same order.
8. PERSONAL DATA
8.1. The Seller will process personal data within the scope of this agreement solely for the purpose of providing the Product and in accordance with Personal Data Protection Law No. 6698, secondary legislation, and the decisions of the Personal Data Protection Board. The Seller acknowledges, declares, and undertakes that it will not process the Customer's personal data other than the personal data it accesses through CemreShop, and that it will not communicate with the Customer externally other than through methods provided through CemreShop.
8.2. The Seller accepts, declares and undertakes that it is obliged to check that the personal data provided under this Agreement is accurate, complete and up-to-date, not to share this information with third parties, to take the necessary precautions, including those regarding viruses and similar harmful applications, to prevent access by unrelated persons, and to ensure the security of the personal data in question; otherwise, it is personally responsible for any damages that may arise and any claims from third parties.
9. RIGHT OF WITHDRAWAL
9.1. If the Customer does not receive the Product for any reason, the Customer will be deemed to have returned the Product and in this case, all payments collected from the Customer, including delivery costs, if any, will be refunded to the Customer within the legal period.
9.2. If the Customer or the third party designated by the Customer is not present at the address at the time of delivery, the Seller shall not be liable for any damages or expenses arising from the Customer receiving the Product late or not receiving it at all.
9.3. The Customer must inspect the Product before accepting delivery; any damaged, defective, or missing Product (such as crushed, broken, torn packaging, etc.) will not be accepted. The Product received will be deemed undamaged and intact. The Customer is responsible for the careful protection of the Product after delivery.
9.4. The Customer has the right to withdraw from the Agreement within 15 (fifteen) days without giving any reason and without paying any penalty. If the right of withdrawal is to be exercised, the Product must not be used and must be returned with the Product invoice and all documents provided to the Customer at the time of delivery.
9.5. In cases where it becomes impossible to supply the product to the Customer, the Seller will notify the Customer in writing within 3 (three) days of learning of this situation. In this case, all payments collected from the Customer will be refunded within 14 (fourteen) days from the date of notification. The fact that the product is not available in stock does not mean that the product supply is impossible.
9.6. In cases where a refund is required to be made to the Customer for any reason within the scope of the Agreement, the Customer accepts, declares and undertakes that the average process for the amount refunded to the credit card by the Seller to be reflected in the Customer account by the bank may take up to 2 (two) to 3 (three) weeks, that the reflection of this amount in the Customer's account after the refund by the Seller to the Bank is entirely related to the Bank's transaction process, and that the Bank is responsible for any possible delays and cannot hold the Seller responsible for these.
10. COMMUNICATION
10.1. For orders placed through cemreshop, Customers may contact us via e-mail at info@cemre.shop between 09:00 and 18:00, Monday to Friday, for support requests and complaints regarding problems they experience during or after shopping.
11. COMPETENT JUDICIAL AUTHORITIES
11.1. Provincial and District Consumer Arbitration Committees have jurisdiction and authority to resolve any disputes that may arise regarding the order, up to the value declared by the Ministry of Commerce of the Republic of Turkey, and Consumer Courts for cases exceeding these limits. The Consumer Arbitration Committee and Courts located where the customer purchased the product/goods and where the customer resides have jurisdiction.
12. EVIDENCE AGREEMENT
12.1. The Customer accepts that in any dispute that may arise from the Contract, the Seller's official books and commercial records, electronic information kept in the database and servers, computer and voice recordings will constitute evidence, and that this article is an evidentiary contract within the meaning of Article 193 of the Code of Civil Procedure.
13. ENFORCEMENT
13.1. All terms and conditions of the Form and Agreement shall come into force immediately upon the Customer's confirmation of the " I have read and accept the Preliminary Information Form and Distance Sales Agreement " option available on cemreshop.
13.2. The Preliminary Information Form and the Agreement will be sent to the email address provided during registration on Cemreshop upon acceptance through Cemreshop. These documents can be accessed through Cemreshop at any time.
